ZP, on behalf of a so-called timeshare “exit company,” had a timeshare developer’s complaint for tortious interference with contract and violation of Florida’s Unfair and Deceptive Trade Practices Act dismissed with prejudice. ZP successfully argued that the continuing tort doctrine does not extend the statute of limitations for such claims in one of, if not the only, lawsuits brought by timeshare developers against exit companies or attorneys who assist timeshare owners to be resolved via motion to dismiss.

ZP is proud to have Florida’s Fifth District Court of Appeal affirm an injunction obtained against a timeshare developer from continuing its marketing tours at a condominium/timeshare association in Daytona Beach, FL. ZP obtained declaratory and injunctive relief on behalf of the association in the trial court and successfully argued before the Appellate Court that the injunction should be affirmed. ZP also obtained orders from the trial and appellate courts determining that ZP’s client was entitled to reimbursement of its reasonable attorneys’ fees and costs from the timeshare developer.

As a result of the Coronavirus Disease 2019 (COVID-19) pandemic, the State Surgeon General and State Health Officer on March 1, 2020, declared that a public health emergency exists in Florida, and the Governor on March 9, 2020, declared a state of emergency for the entire state. The Florida state courts have taken measures to mitigate the effects of this public health emergency upon the judicial branch and its participants.

The Supreme Court issued an addendum/update to this Administrative Order  which in part extends the suspension of Jury Trials through July 2, 2020.

On March 5, 2019, Managing Partner Shannon Zetrouer traveled to Tallahassee to speak to Florida Representatives regarding House Bill 435. The proposed bill, introduced as a measure intending to help timeshare consumers, was ultimately withdrawn from consideration after this hearing.

Ms. Zetrouer spoke in detail about her concerns with the proposed legislation. The main issues with the proposed bill as she saw them are:

• Restraint on trade, the elimination of consumers’ rights, the influence the bill may have of pending litigation,
• The negative impact the bill would have on attorneys attempting to assist timeshare owners,
• High costs of complying with measures in the bill,
• The severity of violations to the bill,
• Over-regulation of businesses assisting timeshare owners,
• Increased harm to consumers due to a mandatory contract disclosure directing owners to contact the Developer before seeking any third-party assistance, and
• Lack of meaningful regulation requirements for the sale of timeshares.
